The higher level of protection recognized today to the individual has made it possible for the legislator to go beyond the limits of the so called "intra-parental immunity" which up to now has limited the liability within the family. The present volume is about the conditions at which it is possible to claim damages from a family member. Particularly sensitive are the times of domestic crises in a marriage, during which parents often cause damage to children on different grounds. This study focuses on the remedies set out in article 709-ter of the Italian code of civil procedure, n. 2 and 3, remedies that some commentators view as punitive damages rather than damage recovery.
