This PhD Thesis consists, for the most part, of an investigation of the metatheory of law regarding some of the main theories of rights as formulated in the Anglo-American sphere in the contemporary era. To a lesser extent, it constitutes a proposal as to some of the relevant components that an analytical theory of rights should incorporate. I have carried out a reconstruction and a critical analysis of the most prominent elements (of the theses and of their implicit commitments) of the theories of rights championed by Bentham, Hart, MacCormick, Raz and Kramer. Likewise, the corpus also includes Hohfeld’s theory, as well as other contributions from the Anglo-Saxon and Latin areas. In the development of this investigation, I use the notion of “interest” as an element of comparison and elucidation of the notion of “subjective right” and I proceed from the hypothesis that rights protect and foster interests, to finally reach a proposal on the function of rights that integrates both interest and will theories. In this investigation, therefore, the reconstructive, the critical and the theoretical tasks are aimed at evaluating and choosing the soundest arguments in relation to the function of rights. In the backdrop of this work may be found the conviction that the analysis of the function of rights constitutes a central element in a theory of rights; in summary, I aim to answer some of the crucial questions that any theory of rights must address.
Questa tesi consiste, in gran parte, in una ricerca di metateoria del diritto avente ad oggetto alcune delle principali teorie dei diritti elaborate in ambito angloamericano in epoca contemporanea. In minor misura, presenta la proposta di alcuni elementi rilevanti che una teoria analitica dei diritti dovrebbe comprendere. Porto a compimento una ricostruzione e un’analisi critica degli elementi più significativi, delle tesi e degli impegni teorici assunti, delle teorie dei diritti difese da Bentham, Hart, MacCormick, Raz e Kramer. Inoltre, il corpus comprende anche la teoria de Hohfeld, così come altri contributi di ambito anglofono e latino. Nello sviluppo della ricerca, impiego la nozione di “interesse” come elemento di paragone e di chiarimento della nozione di “diritto soggettivo” e, partendo dall’ipotesi che i diritti proteggono e promuovono interessi, elaboro, alla fine della ricerca, una concezione della funzione dei diritti che integra la teoria dell’interesse e la teoria della volontà. Così, i compiti ricostruttivo, critico e propositivo sono diretti a stabilire quali siano le argomentazioni più solide in relazione alla funzione dei diritti. Sullo sfondo di questo lavoro vi è la convinzione teorica che la funzione dei diritti costituisce una componente centrale di una teoria dei diritti; in poche parole, pretendo rispondere a domande cruciali che ogni teoria dei diritti deve affrontare.
