I danni punitivi nel sistema della responsabilità civile

The concept of punitive damage suggests a particular way of compensation for damage whose function, far from being resolved in a merely compensatory perspective of the damaged party, is charged with a punitive and deterrent shade. The aim of this work is to investigate the admissibility and compatibility of the institution with the italian liability rules. An investigation plan prompted by the recent Italian Courts interest on the subject, especially in relation to the dialectical verification of the compatibility of punitive damages with the concept of internal and international public order. Infact, the Italian liability law system can legitimately aspire to a multifunctional and dynamic vocation in a broader perspective of effectiveness and completeness protection not only between private but also in a social perspective, in the awareness that "civil liability that does not affect deterrence does not it is a real civil liability ".
