In the italian legal system the Supreme Court, traditionally, can't decide of the merit of the disputes but it can only supervise the uniform application of the law: it can't judge the fact of the case and it can't interpretation of the evidence. This thesis analyses the historical origin of the Court and the reasons why is not allowed the assessment of the quaestio facti in order to demonstrate that this is no more a rational and useful rule.
