La contratación pública electrónica en Italia: Evolución, análisis y propuestas de mejora

The present work is focused on the analysis of the effects of ICT in public procurement procedures. Firstly, this analysis will lead us to evince a legal and economic theoretical substratum which will allow the understanding of the structural dysfunctions dragged by the public procurement procedure from its origins. Therewith, we will detect the main trouble spot, which must be solved by the new effects allowed by ICT, as well as the basic and common elements on which the viability of all e-government procedures are based. These are the starting points from which we will approach e-procurement with a double perspective. On the one hand, we will study "end-to-end" e-public procurement procedures, with a special concern in the analysis of their development without excluding micro, small and medium-sized enterprises. On the other hand, we will focus on the partial implementation of ICT in the general tender procedure, where the proposal of the future ANAC central platform will play a main role, denoting the need to achieve most of the ITC potentialities as interactivity and hypermediality, apparently forgotten by the legislator, and not only some of them like dematerialization. This way, we will try to show the reader -to whom we thank the dedication of his time to read this work- what aspects of the analogical procedure can improve e-procurement, making it worth the efforts and challenges implicit for its implementation at a national level, with the purpose of achieving, ultimately, the real creation of a single market in the European Union, even in relation to public procurement.
