Technological progress has revolutionised the EU single market, for thirty years the frontier of European integration, leading to the development of its digital dimension. The EU institutions have certainly paid particular attention to filling gaps and overcoming critical issues in its regulation, preparing in 2015 the so-called Digital Single Market Strategy, whose repercussions – together with other programmes such as the so-called New Deal and the Green Deal – have been tangible, at least if one looks at the advances in the Union's secondary legislation. The paper analyses the evident changes that the digital transformation has brought about on the notions of 'consumer' and 'professional', considered the 'classic' actors of the traditional market, and on their negotiating positions that have clearly changed (also) due to the emergence of a new protagonist, the digital platform, to whose power the first two subjects are subordinate. The various regulatory interventions of the EU legislator, both to protect digital consumers and professional users, as well as to introduce liability for intermediary platforms, are examined in order to evaluate whether such forms of protection are actually suitable to safeguard the 'weak' subjects of the digital single market.
Il progresso tecnologico ha rivoluzionato il mercato unico dell’UE, da trent’anni anni frontiera dell’integrazione europea, determinando lo sviluppo della sua dimensione digitale. Le istituzioni dell’Unione hanno certamente riposto particolare attenzione a colmare le lacune ed a superare le criticità nella sua regolamentazione, predisponendo nel 2015 la c.d. Strategia per il mercato unico digitale, le cui ripercussioni – insieme ad altri programmi quali il c.d. New Deal e il Green Deal – sono state tangibili, per lo meno se ci si sofferma sugli avanzamenti del diritto derivato dell’Unione. L’elaborato analizza gli evidenti cambiamenti che la trasformazione digitale ha comportato sulle nozioni di “consumatore” e di “professionista”, considerati i “classici” attori del mercato tradizionale, e sulle loro posizioni negoziali manifestamente modificate (anche) per via dell’emergere di una nuova protagonista, la piattaforma digitale, rispetto al cui potere i primi due soggetti risultano soggiacere. I diversi interventi normativi del legislatore dell’UE, sia a protezione dei consumatori digitali, sia degli utenti professionali, nonché di introduzione di casi di responsabilità delle piattaforme intermediarie, sono esaminati al fine di valutare se tali forme di tutela siano effettivamente idonee a salvaguardare i soggetti “deboli” del mercato unico digitale.
