The paper investigates the relationship between common-law and civil-law systems in property matters, with particular attention to the recent debate on possessory models and, in particular, adverse possession. The fascination that the notions of property and possession have always, and still do, exert lies in their relationship and the deep divisions that on the legal level have always resulted from them. Even today, the framework, within which the power relations between property and possession move, is not very harmonious and linear. The relationship between proprietary and possessory models is described by resorting to visions, which oscillate, without apparent elements of contact, from antagonism to complementarity. On the comparative level, this is the field in which, according to many, the divergence between common law and civil law would be expressed to its fullest potential, so much so as to make comparison essentially impossible - and in any case difficult.
Il lavoro indaga il rapporto fra sistemi di common law e di civil law in materia proprietaria, con particolare attenzione al recente dibattito sui modelli possessori e, in specie, sull' adverse possession. La fascinazione che da sempre, e ancora oggi, le nozioni di proprietà e possesso esercitano risiede nella loro relazione e nelle profonde divisioni che sul piano giuridico ne sono sempre derivate. Ancora oggi il quadro, entro il quale i rapporti di forza fra proprietà e possesso si muovono, risulta poco armonico e lineare. La relazione fra modelli proprietari e possessori viene descritta ricorrendo a visioni, che oscillano, senza apparenti elementi di contatto, dall’antagonismo alla complementarità. Sul piano comparatistico, è questo il campo in cui, secondo molti, la divergenza fra common law e civil law sarebbe espressa al suo massimo potenziale, tanto da rendere sostanzialmente impossibile – e comunque difficile – una comparazione.
