The legal system often links a plurality of legal consequences to the same illicit act, which can simultaneously affect the criminal, administrative, and civil sectors. Therefore, the problem of regulating the relationships between the various proceedings that can take place for the same fact arises. This paper aims to focus on the relationships between criminal proceedings and disciplinary proceedings within public employees. The starting point of the study is certainly the so-called "criminal preliminary ruling", provided by the art. 653 c.p.p. The above mentioned article establishes as a fundamental rule the binding effectiveness of the irrevocable criminal sentence in disciplinary proceedings within public authorities. Hence, derogating with the principle of independence of judgements. The argument of the study, therefore, represents an exception full of controversial issues, which leads the interpreter to reflect on the usefulness of this rule in the current procedural system.
L’ordinamento spesso ricollega ad un medesimo fatto illecito una pluralità di conseguenze giuridiche, le quali possono interessare contemporaneamente il settore penale, disciplinare, amministravo-contabile, nonché quello civile. Pertanto, sorge il problema di regolare i rapporti tra i vari procedimenti che possono avere luogo per il medesimo fatto. Il presente lavoro vuole attenzionare i rapporti tra il procedimento penale e il procedimento disciplinare a carico dei pubblici dipendenti. Il punto di partenza dello studio è sicurante la cd. pregiudiziale penale, prevista dall’art. 653 c.p.p., la quale stabilisce come regola fondamentale l’efficacia vincolante della sentenza penale irrevocabile nei giudizi disciplinari davanti alle pubbliche autorità. Ciò, in deroga al principio di indipendenza dei giudizi. Una deroga ricca di questioni controverse che, per alcuni aspetti, induce l’interprete a riflettere sulla utilità di tale norma nell’attuale sistema processuale.
