The corporate crisis is a physiological situation of economic-financial difficulty that can characterize the life of all companies operating on the market in the abstract. The ability to recover from a corporate crisis situation is directly proportional to the ability to identify this crisis in a timely manner and to intervene through corporate recovery and debt restructuring strategies in an equally rapid manner. Starting from the assumption that the company crisis warning and prevention measures must be regulated in our legal system, an empirical research is carried out in the work aimed at analyzing the results deriving from the application of the CCII warning indicators, to then attempt to provide a interpretative key of the normative behavior of the Legislator, through the lens of the "theory of neo institutionalism".
