This thesis examines the complex balance between the need for procedural simplification and environmental protection in the public procurement market, identifying tools and institutions that enable the reconciliation of administrative efficiency with sustainability. The analysis is conducted within a constantly evolving regulatory framework, which has progressively placed environmental sustainability at the core of administrative decision-making, in line with European directives and the new Public Procurement Code. Through the examination of international, European, and Italian regulations, the study explores the evolution of the principle of sustainable development and investigates the integration of environmental protection within public contract law. It highlights the importance of key instruments designed for this purpose, such as environmental management systems, minimum environmental criteria (MEC), the most economically advantageous tender (MEAT) criterion, and life cycle cost analysis. Furthermore, it analyzes the role of administrative simplification in public procurement, focusing on key mechanisms such as digitalization, environmental impact assessment (EIA), and the conference of services. The research ultimately demonstrates how these objectives can be harmonized to achieve a more sustainable and effective management of public procurement, offering reflections and solutions that contribute to the broader debate on the subject.
La presente tesi esamina il complesso equilibrio tra le esigenze di semplificazione e la tutela dell’ambiente nel mercato delle commesse pubbliche, individuando strumenti e istituti che consentano di coniugare l’efficienza procedurale con la sostenibilità. L’analisi si sviluppa all’interno di un quadro normativo in continua evoluzione, che ha progressivamente centralizzato la sostenibilità ambientale nelle scelte amministrative, in linea con le direttive europee e il nuovo Codice dei contratti pubblici. Tramite l’analisi delle normative internazionali, europee e italiane, approfondisce l’evoluzione del principio di sviluppo sostenibile ed esamina il processo di integrazione della tutela ambientale nella disciplina contrattuale pubblica, sottolineando l’importanza di strumenti fondamentali, preposti a tale scopo, come i sistemi di gestione ambientale, i criteri minimi ambientali (CAM), il criterio dell’offerta economicamente più vantaggiosa e l’analisi del costo del ciclo di vita. Tratta, inoltre, la disamina del ruolo della semplificazione amministrativa nel settore dei contratti pubblici, focalizzandosi sugli istituti della digitalizzazione, della VIA, e della conferenza di servizi. La ricerca, infine, dimostra come sia possibile armonizzare questi obiettivi per una gestione più sostenibile ed efficace degli appalti pubblici, proponendo riflessioni e soluzioni che contribuiscano al dibattito sul tema.
