The thesis work is mainly focused on the analysis, in domestic and supranational perspective, of the repressive discipline concerning public bribery. After a brief criminological examination (Ch. I) aimed at studying the phenomenon both from a qualitative point of view (forms of manifestation) and from a qualitative one (measurement methodologies), the legislative formant was examined (Ch. II), first, through consideration of the main sources of European and international and later through the screening of domestic reform initiatives. Having grasped the trends and constants of the “permanent anti-corruption worksite,” it was decided to devote the last two chapters, respectively, to the issue of protected legal objectivity (Ch. III) - an investigation, also conducted taking into account the profiles of harmfulness highlighted in the European context - and finally to the analysis of the main structural components (Ch. IV) of the corruptive offenses.
Il lavoro di tesi è principalmente incentrato sull’analisi, in prospettiva interna e sovrannazionale, della disciplina repressiva concernente la corruzione pubblica. Dopo una breve disamina di natura criminologica (Cap. I) volta allo studio del fenomeno tanto dal punto di vista qualitativo (forme di manifestazione), quanto da quello qualitativo (metodologie di misurazione), si è proceduto ad esaminare il formante legislativo (Cap. II), dapprima, attraverso la considerazione delle principali fonti di matrice europea ed internazionale ed in seguito mediante il vaglio delle iniziative di riforma interna. Colte tendenze e costanti del “cantiere permanente anticorruzione”, si è scelto di dedicare gli ultimi due capitoli, rispettivamente, alla questione dell’oggettività giuridica tutelata (Cap. III) – indagine, anch’essa condotta tenendo conto dei profili di lesività evidenziati in sede europea – ed infine all’analisi delle principali componenti strutturali (Cap. IV) delle fattispecie corruttive.
