The thesis concerns the concurrence of laws and its regulation under the European Union’s conflict-of-laws framework. The expression “concurrence of laws” is used in the thesis to designate the situation, arising when substantive rules, produced by the sources of multiple national legal systems, are simultaneously applicable to the same case, as a result of the application of one or more conflict-of-laws rules. The subject, already addressed in some theoretical writings, is examined within the European Union’s conflict-of-laws framework. As a result of the concurrence of laws, problems of substantive disharmony may arise (that is, the production of a dysfunctional substantive regulation of the case at hand), as well as prejudice to the harmony of decisions (which occurs when the same case receives different treatment depending on the legal system from whose perspective it is considered). In summary, the solutions to the problems caused by the concurrence of laws may concern either the choice of the applicable law or the application of the substantive rules of the laws in concurrence. Starting from the nature and distinctive features of the European Union's conflict-of-laws rules, the thesis investigates the role of the principle of foreseeability. This principle is examined in light of its bearing on the solutions to be adopted in response to the problems caused by the concurrence of laws. Having observed that the European Union’s conflict-of-laws framework offers limited scope for intervention at the level of the applicable law — owing to the role assumed by the principle of foreseeability — the thesis focuses on the status of private international law techniques of adaptation within the European Union’s conflict-of-laws framework.
La tesi riguarda il concorso di leggi e il trattamento riservato a tale fenomeno nella disciplina dell’Unione europea dei conflitti di leggi. L’espressione “concorso di leggi” è impiegata, nella tesi, per designare la situazione che si verifica allorché norme materiali, prodotte dalle fonti di plurime leggi statali, risultano simultaneamente applicabili alla medesima fattispecie, per effetto del richiamo disposto da una o più norme di conflitto. Il tema, già oggetto di alcune trattazioni teoriche, viene affrontato nella disciplina dell’Unione europea dei conflitti di leggi. Per effetto del concorso di leggi, possono prodursi problemi di disarmonia materiale (ovvero la produzione di una disciplina materiale disfunzionale della fattispecie), e pregiudizi all’armonia delle decisioni (ciò si verifica, allorquando la medesima fattispecie riceva una disciplina diversa, a seconda della prospettiva ordinamentale considerata). In sintesi, le soluzioni ai problemi causati dal concorso di leggi possono riguardare l’individuazione della legge applicabile, oppure l’applicazione delle norme di diritto materiale delle leggi in concorso. Muovendo dalla natura e dalle caratteristiche della disciplina dell’Unione europea dei conflitti di leggi, la tesi indaga il ruolo del principio di prevedibilità, nella determinazione delle soluzioni da adottare ai problemi causati dal concorso di leggi. Rilevato che la disciplina dell’Unione offre limitati margini di intervento sul piano della legge applicabile – in ragione del ruolo assunto dal principio di prevedibilità –, la tesi si sofferma sullo statuto delle tecniche di adattamento internazionalprivatistico nella disciplina dell’Unione europea dei conflitti di leggi.
