This study aims to analyze the complex relationship between law, rights, and the management of emergencies, with particular attention to the Italian institutional context. The notion of emergency — or, more precisely, the legal and institutional response to events that give rise to it — has always represented a central issue within legal scholarship. In the aftermath of the pandemic, the doctrinal debate on emergency has gained renewed momentum, becoming fertile ground for new theoretical and practical reflections. This perspective acquires even greater significance today in light of the challenges posed by new-generation emergencies, particularly the climate and environmental crises, which are reshaping the boundaries of emergency governance and calling for a reconsideration of traditional legal and institutional instruments.
Questo studio si propone di analizzare la complessa relazione tra diritto, diritti e gestione delle emergenze, con particolare attenzione al contesto istituzionale italiano. L’emergenza — o, più precisamente, la risposta giuridica e istituzionale a eventi che ne determinano l’insorgere — costituisce da sempre un tema centrale nelle scienze giuridiche. Alla luce dell’esperienza pandemica, il dibattito dottrinale sull’emergenza ha conosciuto un rinnovato impulso, divenendo terreno fertile per nuove riflessioni teoriche e applicative. Tale prospettiva assume oggi una rilevanza ancora maggiore di fronte alle sfide poste dalle emergenze di nuova generazione, in particolare quella climatica e ambientale, che ridefiniscono i confini del governo dell’emergenza e sollecitano una revisione degli strumenti giuridici e istituzionali tradizionali.
