This research aims to investigate the extent to which legislative autonomy can be exercised by the Italian Regions in the field of public procurement, and in particular by the Autonomous Regions with a Special Statute. The purpose is to exploit the potential of such instruments for the economic development of the territory. The study subject has been developed starting from general perspective, with the objective of understanding the impact of public procurement on the economy and on the internal market of the European Union and its Member States. It examines how public procurement constitutes a strategic tool of administrative action and a means to pursue primary public interests and implement public policies. Furthermore, the study is complemented by a comparative analysis of public procurement regulations within two European legal systems (the French and the German) which represent two distinct models in terms of state institutional structure. Regarding the national legal framework, the research reconstructs the evolution of Italian legislation up to the 2023 Public Procurement Code. It then analyses the regional system and the allocation of legislative competences in the field of public procurement. Indeed, the attribution of legislative powers has given rise to significant conflicts between the State and the Regions. The Italian Constitutional Court, through numerous rulings, has defined the limits imposed on regional autonomy in this field. Finally, based on the case study of the Autonomous Region of Friuli-Venezia Giulia, the research proposes the use of administrative organizational autonomy to implement solutions suited to specific territorial needs. As a possible structural reform, it identifies the establishment of a Regional Public Procurement Agency for Friuli-Venezia Giulia.
Il presente lavoro di ricerca si propone di indagare quali spazi possano essere devoluti all’autonomia legislativa delle Regioni italiane e, in particolare, delle Regioni a statuto speciale in materia di contratti pubblici, con lo scopo di sfruttare le potenzialità di tali strumenti a favore dello sviluppo economico del territorio. Il tema oggetto della ricerca è stato elaborato partendo da una prospettiva di carattere più generale, con l’obiettivo di comprendere l’impatto effettivo dei contratti pubblici sull’economia e sul mercato dell’Unione e degli Stati membri. In questo senso, si è analizzato in quale modo il procurement pubblico costituisca a tutti gli effetti uno strumento strategico dell’azione amministrativa e un mezzo per perseguire interessi pubblici primari e attuare politiche pubbliche. La ricerca è stata altresì integrata da una prospettiva di carattere comparato attraverso lo studio della disciplina dei contratti pubblici all’interno di due ordinamenti europei, quello francese e quello tedesco, che rappresentano due modelli diversi per sistema e assetto istituzionale. Per quanto attiene alla disciplina nazionale, l'analisi ha ricostruito l'evoluzione della normativa italiana sino al nuovo Codice dei contratti del 2023, per poi approfondire il sistema regionale e il riparto delle competenze legislative in materia di contratti pubblici. Il tema del riparto delle competenze legislative nel settore, infatti, ha dato origine a un rilevante contrasto tra Stato e Regioni e a numerose pronunce della Corte costituzionale, la quale ha definito in concreto i limiti posti all’autonomia regionale. Infine, partendo dal caso di studio del Friuli-Venezia Giulia, la ricerca propone di utilizzare l'autonomia organizzativa delle Regioni per implementare soluzioni adeguate alle specifiche esigenze territoriali. In particolare, come possibile riforma strutturale, si individua l'istituzione di un'Agenzia regionale dei contratti pubblici del Friuli-Venezia Giulia.
