Migratory phenomenon is an important factor in criminal law. It rappresents fast cultural changes and therefore the everlasting issue of the relationship between criminal law and heritage and morality. Sensitive institutions are the normative elements, in particular the extra-legal component. In the first section it analyzes the tenets of the normative elements in criminal law, with focus on the german tenets. The second one is the in-depth analysis of the cultural, normative elements in german and italian sexual offences legislation.
