The reg. n. 650 of July 2012 established a European Certificate of Succession. It introduces in EU-member States a uniform and standardized system of proof of the status of an heir or a legatee and of the powers of an administrator or executor. By this way, it intends to facilitate the recognition of these qualities and powers, providing, at the same time, new and more effective forms of protection for third parties within the circulation of cross-boarder succession property. After a comparison between the solutions pursued in this matter by each national legal system, this contribution examines the terms of integration of the European Certificate of Succession within EU Countries, with particular regard to the relationship of the European Certificate of Succession to the Member-State s existing and equivalent certificates or procedures. Particular focus has been dedicated to the applicative effects of the new instrument within the Italian legal system and its interactions with the mechanism of protection already afforded by art. 534, paragraph 2, of the Civil Code. Such an approach leads us finally to highlight certain operative criticalities of the European protection mechanism, suggesting, at the same time, the possible solutions.
Il reg. (UE) n. 650 del 4 luglio 2012 ha istituito un certificato successorio europeo. Questo introduce nei Paesi dell Unione un sistema di prova uniforme e standardizzato della qualità di erede o di legatario e dei poteri di amministratore o esecutore testamentario al fine di agevolare l attuazione delle successioni transfrontaliere, facilitando il riconoscimento di tali qualità e/o poteri e predisponendo, al contempo, nuove e più efficaci forme di tutela dei terzi nell ambito della circolazione dei diritti ereditari. Dopo un raffronto comparatistico tra le soluzioni perseguite in questa materia dai singoli ordinamenti nazionali, la presente ricerca esamina i termini d integrazione del certificato successorio europeo all interno dei Paesi dell Unione, con particolare riguardo alla questione del rapporto tra certificato successorio europeo e analoghe attestazioni nazionali. Specifica attenzione è stata dedicata, in particolare, agli effetti applicativi del nuovo istituto all interno dell ordinamento italiano e alle sue interazioni con il meccanismo di tutela già predisposto dall art. 534, comma 2, c.c.. Per tale via la ricerca perviene infine a evidenziare talune criticità operative del meccanismo di tutela di matrice europea, prefigurandone al contempo le possibili soluzioni.
