2012 has been proclaimed as the European year of "Active ageing and solidarity between generations". EU population is indeed facing a constant increase of life expectancy, which brings the need for an extension of the working career of every single individual. The question is how to achieve this, within an economical crisis, characterized by augmenting unemployment rates and cuts to the welfare system. EU promotes Flexicurity as a solution, with particular reference to the implementation of the policies of Lifelong Learning (chapter 1). After a thorough analysis of the various Flexicurity existing models (chapter 2) and a verification of the Italian model, before and after the reform introduced with L. 92/2012 (chapter 3) it will be analyzed how Italy assures itself that art. 4 and 35 paragraph of the Constitution are applied. Essential for this control is to define the tools (public and contractual) that assure to an Over50 worker a constant adjustment of his working background. This protects his position and allows him a better placing possibility. The analysis is conducted focusing on the tools of Lifelong Learning which allows constitutional forecast both on the relationship between individuals and state (chapter 4) and in the individual relations on a contractual level (chapter 5). Particular attention will be dedicated to the contractual cause and to the presence of duty to the vocational and continuous training.
