This research aims to investigate the implementation of Article 27 of the Consolidated Act of 2008 on health and safety in relation to enterprises and self-employed workers’ qualification. It underlines the cultural and legislative path which has led to a similar prevision, starting from a detailed analysis of the law by which the Consolidated Act derived (which is also the source of the new qualification system). The mentioned Consolidated Act has identified two priority areas in which a process of new qualification systems starts: hygienizing textile materials and surgical instruments, and building sector. The analysis therefore focuses on these two areas and the attempts that the social partners have advanced during the years, with a particular attention to the building sector and its “patente a punti”: an instrument created by Filca Cisl (one of the Union representing construction workers) to regulate the sector. The research therefore aims to highlight the potential of this tool, but also the problems met during the years by all the actors involved in managing it. Unfortunately, after many years, the standard has not been implemented yet.
