Abstract. The present work is centered on the objective of building a legal theory around the exclusionary rule of illegally obtained evidence, in order to allow the identification of its two key components: The application opportunity, consistent with the particular prohibition that supports the rule and the content of its effect; as well as the procedural regime that binds such rule. As an indispensable assumption with regards to the described end, a critical and descriptive analysis, centered on the way the exclusionary rule operates in the Italian and Spanish legal systems, will be useful as a sign of the existence of a systemic divergence between the rule’s validity and it’s efficiency. This process hopes to help demonstrate the insufficiency of the axiological foundation that supports the rules for suppression of evidence, specially in regards to the exclusionary rule. In this manner, the claim for the identification of a proprietary axiological foundation for the exclusionary rule is proposed which should, under the Rule of Law, drive us to a re-imagination of the concept of proof, capable of a well rounded and harmonic solution to the claim of protecting fundamental rights which might be violated during proof related activities in criminal trials.
Abstract. La presente tesi di ricerca si propone l’obiettivo di elaborare una teoria giuridica sulla regola di esclusione della prova illecita che permetta di delineare con precisione i suoi due elementi strutturali, ossia la sua ipotesi applicativa consistente nel peculiare divieto posto alla base della medesima nonché il suo effetto ed il regime giuridico a cui la medesima deve uniformarsi. Quale indispensabile presupposto, si effettua una analisi critico-descrittiva riguardo alla modalità con cui la regola di esclusione della prova illecita opera negli ordinamenti giuridici italiano e spagnolo, rilevatrice dell’esistenza di una divergenza deontica tra la vigenza della regola e la sua efficacia operativa. In tal modo si intende dimostrare la non sufficienza del fondamento assiologico posto a base dell’esclusione della prova, al fine di dare una idonea risposta al fenomeno della prova illecita. In tal modo, si propone l’identificazione del fondamento assiologico “proprio” per questo tipo di regola, che alla stregua del paradigma costituzionale di uno Stato Democratico di Diritto, conduce infine a compiere una rilettura del concetto misto di prova, capace di fornire una soluzione concatenata e armonica alla sfida iniziale di dare effettiva tutela ai diritti fondamentali lesi nel corso dell’attività probatoria dei processi giudiziali in generale e, in particolare, del processo penale.
