The thesis addresses from the perspective of public law the issue of ethically sensitive decisions taken in the health system. In particular, starting from the right to health, we examine the relationship between protection of individual freedoms and protection due to the person incapable of self-determination. It also examines the issue of possible conflicts between government and individuals who practice in the legal representative of patient, moreover to identify what organizational or legislative solutions are able to prevent or at least resolve them in the best interest of the incapacitated person.
