Do constitutions effectively protect fundamental rights on the Internet? Or do states have to set specific constitutions, like "lex digitalis", in order to protect fundamental rights when it comes to the Internet? The thesis aims at exploring the constitutional implications arising out of the new technological scenario in terms of fundamental rights protection. The goal of this work is to determine whether the frequent claims of "Internet bill of rights" or "digital constitutions" have to be accepted or denied. Focusing on the fundamental rights mostly affected by the rise of the Internet (freedom of speech, right to privacy and data protection, copyright), the thesis does highlight the role of courts and regulatory authorities for an effective protection to be achieved. In light of the foregoing, the assumption is challenged that to enjoy constitutional protection these rights should be expressly laid down by specific digital constitutions.
