The research deals with the notion of public employer in the field of health and safety in the workplace, currently regulated by Article 2 (1)(b), Legislative Decree No. 81/2008. Firstly, the research considers the evolution of the discipline from an historical point of view, highlighting both the effects and the main issues concerning its application in the Public Sector. Secondly, it takes into account the notion of public employer in the light of the privatization process that involved the public employment, making a comparison between the latter and the private one. In conclusion, the research investigates the unsolved profiles concerning the definition of public employer provided by the so-called Testo Unico of Health and Safety at the Workplace, questioning the opportunity/necessity to use different notions in relation with the figure of the employer in both the private and the public sectors.
