The purpose of this research is to analyze the alternative combination of claims – which occurs when more than one claim is proposed in order to accept one or the other, without the plaintiff expressing any preference for the acceptance of one rather than the other – with a view to outlining the structure of the alternatively combined process, defining in particular the nature of the decision on the unsuccessful claim, and to outline the limits of admissibility. In the absence of legislative confirmation, it is necessary to verify the compatibility of the phenomenon with the principle of party disposition and with the prospected indeterminacy of the object of the judgment in which the claims are formulated. The first chapter explores the general profiles of alternative claims within the framework of the problem of the conditional cumulation of claims. The object of the investigation also includes the subjective alternative cumulation of claims. On the contrary, the study is not concerned with the request for condemnation to alternative services and the request for alternative assessment in the title or object, since they are erroneously attributed to the phenomenon of alternative claims. In the same way, for reasons of substantial order, it is excluded that the elective competition can configure an alternative cumulation. In the second chapter, the typical cases in which the interest of the party in proposing alternative claims is manifested are researched, distinguishing between the hypotheses of claims being either incompatible, «coplanar», competing, and «improperly» connected. In the third chapter are analyzed the limits of admissibility of the alternative cumulation, starting from the thesis of the procedural conditionality and the procedural nature of the absorption and comparing it with other reconstructions of the object of the absorption, as well as with solutions that refer to the definitions of lack of interest in bringing proceedings and termination of the matter in dispute. Particular attention is paid to the problem of the reiteration of judgments, which leads to an in-depth examination of the position of the defendant and his power to make the cumulation unconditional. In the second part of the third chapter is investigated the issue of uncertainty of the thema decidendum of the judgment alternatively cumulated, in parallel with the question of the violation of the principle of dispositive, in the light of the criterion of the most liquid reason as the only guide for the judge, that is, excluding that it is a syndicate of merits of protection.
Lo scopo della presente ricerca è quello di analizzare il cumulo alternativo di domande – che si verifica quando sono proposte più domande affinché sia accolta o l’una o l’altra, senza che l’attore esprima alcuna preferenza per l’accoglimento di una piuttosto che dell’altra – nella prospettiva di delineare la struttura del processo alternativamente cumulato, definendo in particolare la natura della decisione sulla domanda non accolta, e di tracciarne i limiti di ammissibilità. In assenza di conferme legislative si rende necessario verificare la compatibilità del fenomeno con il principio dispositivo e con la prospettata indeterminatezza dell’oggetto del giudizio in cui le domande sono formulate. Il primo capitolo ha ad oggetto i profili generali delle domande alternative nel quadro della problematica del cumulo condizionale di domande. L’oggetto dell’indagine ricomprende anche il cumulo alternativo litisconsortile. Al contrario, esulano dallo studio, poiché erroneamente ricondotte al fenomeno delle domande alternative, la domanda di condanna a prestazioni alternative e la domanda di accertamento alternativo nel titolo o nell’oggetto. Così come si esclude, per ragioni di ordine sostanziale, che il concorso elettivo possa configurare un cumulo alternativo. Nel secondo capitolo sono ricercate le fattispecie tipiche in cui si manifesta l’interesse della parte alla proposizione di domande in via alternativa, giungendo a distinguere tra le ipotesi di azioni incompatibili, complanari, concorrenti e «impropriamente» connesse. Nel terzo capitolo sono analizzati i limiti di ammissibilità del cumulo alternativo muovendo dalla tesi della condizionalità processuale e della natura processuale dell’assorbimento e mettendola a confronto con altre ricostruzioni dell’oggetto dell’assorbimento, nonché con soluzioni che fanno capo alle definizioni di carenza di interesse ad agire e di cessazione della materia del contendere. Particolare attenzione è riservata alla problematica della reiterazione dei giudizi, che porta ad approfondire la posizione del convenuto e il suo potere di rendere incondizionato il cumulo. Nella seconda parte del terzo capitolo è indagato il tema dell’incertezza del thema decidendum del giudizio alternativamente cumulato, parallelamente alla questione sulla violazione del principio dispositivo, alla luce del criterio della ragione più liquida come unica guida per il giudice, cioè escludendo che si tratti di un sindacato di meritevolezza della tutela.
