The thesis deals with the them of The effect of national legal systems on the definition of the european laicity. The first chapter considers the evolution of the italian legal system from its confessional period to the statement of the “supreme principle of laicity” by the Constitutional Court. The second chapter considers the relationship models between State and religious groups in Europe. In particular, the focus is on the legal protection of religion and the question of religious symbols in the United Kingdom. The third chapter considers laicity in the E.U. and within the E.C.H.R. system. In conclusion, some final considerations about the case-law of the Europen Court of Human Rights and a first reading of the judgment Eweida and others v. United Kingdom.
