This thesis aims to examine the regulation of insurance contracts in Japan as amended following the introduction of the Insurance Act of 2008. The study of this reform, embedded within the context of a fundamental process of modernization of the country's Private Law, provides significant insights into framing the general principles underlying Japanese Contract Law, the relationship between negotiation autonomy, technical-structural elements of insurance, and consumer’s rights protection, as well as the role played by courts in this field of law. Building upon numerous comparative studies focusing on Japan, the work begins with a review of the state of the art, particularly addressing the general characteristics of the system, comparative issues, and key taxonomic classifications. Having defined the methodology, the research proceeds with an analysis of the sources of Japanese insurance contract law, with particular attention to the interaction between positive law and general principles, and the innovative role played by the judiciary in this matter’s development. Subsequently, the regulation of insurance contracts will be analytically examined, taking into account how case law, doctrine, and contractual practice supplement and complement sector-specific legislation. Finally, considering the significant integration of Artificial Intelligence systems in the creation, underwriting, and management of insurance contracts in recent years, some remarks will be devoted to the Japanese approach to the governance of Artificial Intelligence systems and Insurtech.
La presente tesi si propone di esaminare la disciplina del contratto di assicurazione in Giappone come modificata a seguito dell’introduzione dell’Insurance Act del 2008. Lo studio della riforma, che si inserisce nel contesto di un fondamentale processo di modernizzazione del diritto privato del paese, offre importanti spunti per un inquadramento dei principi generali alla base del diritto contrattuale giapponese, del rapporto tra autonomia negoziale, elementi tecnico-strutturali dell’assicurazione e tutela dei diritti, nonché del ruolo svolto dalle corti nella definizione della materia. Il lavoro, inserendosi nel solco dei numerosi studi comparatistici che hanno avuto come oggetto il Giappone, si apre con una ricostruzione dello stato dell’arte con particolare riguardo alle caratteristiche generali del sistema, alle problematiche della comparazione e alle principali classificazioni tassonomiche. Definito quindi il metodo, la ricerca prosegue con un'analisi delle fonti del diritto del contratto di assicurazione del Giappone, con precipua attenzione all’interazione tra norma positiva e principi generali e alla funzione innovativa della materia svolta dai tribunali. Successivamente la disciplina del contratto di assicurazione sarà analiticamente esaminata in considerazione di come giurisprudenza, dottrina e prassi contrattuale integrino e complementino la normativa di settore. Infine, in considerazione degli importanti casi di integrazione di sistemi di Intelligenza Artificiale alla creazione, sottoscrizione e gestione del contratto di assicurazione degli ultimi anni, alcuni cenni saranno dedicati all’approccio giapponese alla governance dei sistemi di intelligenza artificiale e dell’Insurtech.
