The subject matter of this thesis is that of company work inspections. This is a topic that in recent years has been in the subject of a complex legislative business. This began with the D.Lgs 276/2003, followed by the D.Lgs 124/2004, which reframed the whole matter of company inspections, introducing new possibilities for employees and companies. Followed by the introductions of important changes, such as the introductions of the Code of conduct for inspectors in 2006 and later coming to the latest changes represented by the Ministerial directive and by the ‘Collegato Lavoro’. The aim is primarily to highlight the framework of the Ministery of work and the expertise of the peripheral Offices even in relation to the legislative evolution. The focus is on checking procedures, in particular on the various phases of inspection visits, highlighting the changes to inspection minutes carried out by the various agencies involved. The second part of the thesis is centred on the actual effects that the inspection has on the employer and on his possibilities of defending himself, introducing defensive papers or appeals either at an administrative or jurisdictional level. Finally, the last issue to be dealt with concerns the certification of work contracts. A formality motivated by the Legislators in order to attempt to reduce contentious issues, as well as giving the companies the possibility to obtain an approval, in advance, for the type of contract offered to their employees.
La presente tesi ha ad oggetto l’ispezione del lavoro in azienda, argomento che negli ultimi anni è stato al centro di una complessa attività legislativa, iniziata con il D.Lgs 276/2003, proseguita con il D.Lgs 124/2004 che ha riformulato l’intera materia delle ispezioni in azienda introducendo nuove possibilità per lavoratori ed azienda, per passare all’introduzione di importanti novità come l’introduzione nel 2006 del Codice di comportamento per gli ispettori, fino a giungere alle ultime novità rappresentate dalle direttive Ministeriali e dal Collegato Lavoro. Con tale lavoro si cerca di porre in evidenza in primo luogo la struttura del Ministero del Lavoro e le competenze degli Uffici periferici anche in relazione all’evoluzione normativa, quindi si focalizza l’attenzione sulle procedure di accertamento ed in particolare sulle varie fasi della visita ispettiva; vengono messe in risalto le novità relative ai verbali ispettivi con la predisposizione del verbale unificato realizzato mediante collaborazione tra i vari enti. La seconda parte della tesi è incentrata sui concreti effetti che l’ispezione produce sul datore di lavoro e sulle possibilità che ha egli di potersi difendere proponendo scritti difensivi o ricorsi sia in sede amministrativa sia giurisdzionale. Infine l’ultimo punto affrontato riguarda la certificazione dei contratti di lavoro, modalità che viene incentivata dal Legislatore al fine di tentare di fare diminuire il contenzioso ed allo stesso tempo di dare la possibilità alle aziende di ottenere in anticipo un approvazione della tipologia di contratto proposta al lavoratore.
