This paper examines the current structure of Italian inheritance law in relation to the administration of the estates upon death. It highlights the existing gaps in the protection of the interests of the subjects involved in the succession process, and proposes a stronger role for the judicial administration of the estate as a subsidiary tool for safeguarding hereditary assets during the pending succession process. It critically discusses the currently dominant interpretation of the rules on temporary administration, which entrusts the management of the estate to the discretion of the subject who is called to inherit, and emphasizes the need to broaden the scope of judicial administration, especially in light of the ongoing demographic, economic, and social changes in Italy. In this regard, Italian law appears anomalous if compared to other European legal systems, such as the German and French ones, which have already implemented appropriate solutions. The paper therefore proposes a reworking of the judicial administration, recognizing its role as an objective safeguard tool for the estates that are not adequately administrated upon the death of their owner. Consequently, it suggests a renewed interpretation of the requirement of possession, in terms of a full power over the assets, including digital assets, demonstrating the heir’s interest in the estate and requiring the quick completion of the succession process. The research also addresses some controversial issues that have emerged in practice, such as the obligation of the administrator to pay the inheritance tax, his legitimacy to exercise the actio interrogatoria, and his right to challenge the validity and effectiveness of the de cuius’ testamentary dispositions, proposing solutions for a more effective estate administration. Ultimately, the paper aims to extend the scope of judicial administration and enhance its role in responding to new needs and simplifying estate administration procedures, addressing both traditional legal issues and emerging challenges in the digital context.
Lo scritto esamina l’attuale assetto del diritto successorio italiano in relazione all’amministrazione interimistica dell’eredità, evidenziando le lacune di tutela degli interessi dei soggetti coinvolti nella vicenda successoria e proponendo una valorizzazione della curatela dell’eredità quale strumento sussidiario di salvaguardia dei patrimoni ereditari nella fase di pendenza ereditaria. Viene illustrata criticamente l’interpretazione oggi dominante delle regole in tema di amministrazione temporanea, che affidano la gestione del patrimonio ereditario alla discrezionalità del chiamato, e si sottolinea la necessità di ampliare l’ambito operativo della curatela giudiziale, soprattutto alla luce dei cambiamenti demografici, economici e sociali in atto. Sotto questo profilo, il diritto italiano risulta anomalo rispetto ad altri ordinamenti europei, come quelli tedesco e francese, che hanno già integrato adeguate soluzioni. Il testo propone dunque una rielaborazione dell’istituto della curatela giudiziale, riconoscendo all’istituto una funzione cautelativa oggettiva dei patrimoni ereditari non adeguatamente tutelati alla morte del loro titolare. Si propone, conseguentemente, una rinnovata lettura del requisito del possesso del chiamato, nei termini di un pieno potere sui beni ereditari, anche di natura digitale, che dimostri il suo interesse per le sorti del patrimonio ereditario e richieda la rapida definizione del procedimento successorio. La ricerca affronta, inoltre, alcune questioni controverse emerse nella prassi, come l’obbligo del curatore di pagamento dell’imposta di successione, la sua legittimazione ad esperire l’actio interrogatoria e quella a contestate la validità e l’efficacia delle disposizioni testamentarie del de cuius, proponendo soluzioni per un’amministrazione più efficace e tempestiva, nell’ottica della migliore salvaguardia dei patrimoni sottoposti alla curatela. In definitiva, il lavoro si propone di estendere l’ambito operativo e valorizzare la curatela giudiziale, per rispondere alle nuove esigenze di tutela e semplificare le pratiche di amministrazione dell’eredità, affrontando sia le questioni giuridiche tradizionali che le sfide emergenti nel contesto digitale.
