The thesis aims to offer a reflection on the complex but interesting topic of the order of questions of merit in civil proceedings at first instance. The topic will be analysed based on the latest doctrine and case law. The thesis - which represents the outcome of a research and study of sources as well as, above all, an analysis of the debate that exists within doctrine and jurisprudence - aims to investigate the structure of decision-making activity and verify, on the one hand, whether or not the court is bound by a strict order for examination and decision of the questions and, on the other hand, whether or not the parties are holders of power capable of influencing it. Having said this, the work is divided into three chapters. The first is devoted to the analysis of introductory concepts essential for an adequate understanding of the subject matter under investigation. The second is devoted to the study of the fundamental principles of the system that inform the subject matter under investigation. The third, finally, is devoted to the search for the order of decision of questions of substance with particular attention to the powers of the parties. This work, carried out with sincere interest has the humble aspiration to be a contribution to the announced issues that touch on the core of civil procedural law regarding, precisely, the decision-making activity of the judge. It is useful to point out that the analysis has focused on the procedural aspects of the order of questions of substance in relation to the first instance. It follows that the substantive law profiles of the subject (which could dictate a different order) will not be covered and the topic of the appeal of the decision by which the court has violated the order imposed by the law or imprinted by the party will not be covered. The topics will be the subject of further research, which will hopefully result in further contributions.
La tesi si pone l’obiettivo di offrire una riflessione sul tanto complesso quanto interessante tema dell’ordine delle questioni di merito nel processo civile di primo grado. La tematica verrà analizzata prendendo le mosse dalla più recente dottrina e giurisprudenza. La tesi – che rappresenta l’esito di un percorso di ricerca e di studio delle fonti nonché, soprattutto, di analisi del dibattito esistente in seno alla dottrina e alla giurisprudenza – vuole indagare circa la struttura dell’attività decisoria e verificare, da un lato, se il giudice sia o meno vincolato ad un rigido ordine di esame e di decisione delle questioni e, dall’altro lato, se le parti siano o meno titolari di un potere in grado di influire su quest’ultimo. Ciò detto, il lavoro si compone di tre capitoli. Il primo è dedicato all’analisi dei concetti introduttivi indispensabili ai fini di una comprensione adeguata della tematica oggetto di indagine. Il secondo è dedicato allo studio dei principi cardine dell’ordinamento che informano la materia oggetto di indagine. Il terzo, infine, è dedicato alla ricerca dell’ordine di decisione delle questioni di merito con particolare attenzione ai poteri delle parti. Il presente lavoro, realizzato con sincero interesse ha l’umile aspirazione di porsi come contributo alle tematiche annunciate che toccano il fulcro del diritto processuale civile riguardando, appunto, l’attività decisoria del giudice. Si ritiene utile segnalare che l’analisi si è concretata sui profili processuali dell’ordine delle questioni di merito in relazione al primo grado di giudizio. Ne deriva che non saranno tratti i profili di diritto sostanziale del tema (che potrebbero dettare un ordine diverso) e non sarà trattato il tema dell’impugnazione della decisione con la quale il giudice abbia violato l’ordine imposto dalla normativa o impresso dalla parte. Le tematiche saranno oggetto di ulteriore attività di ricerca che, auspicabilmente, confluirà in ulteriori contributi.
