The research work outlines the boundaries of the theme of the progressive expansion of the institution of ‘remote’ participation in the trial and its controversial relationship with the constitutional guarantees placed to protect the criminal investigation. The analysis of the constitutional foundations of the phenomenon and the regulatory evolution that has characterised it, made it possible to highlight the motivations underlying the increasingly widespread recourse to the instrument of audiovisual connection and the possible implications on the guarantees of due process, such as orality, immediacy, cross-examination and the right of defence. The thesis dwells, in particular, on the consequences of the "distance" participation on the traditional testimony, delving into the value of the consent of the parties and the case of the vulnerable declarant. Finally, after reviewing some pathological hypotheses of the institution under consideration, through hints of comparative law, the future orientations of the legislator are hypothesised.
Il lavoro di ricerca delinea i confini del tema della progressiva espansione dell’istituto della partecipazione al dibattimento “a distanza” e del suo controverso rapporto con le garanzie costituzionali poste a presidio dell’accertamento penale. L’analisi dei fondamenti costituzionali del fenomeno e l’evoluzione normativa che lo ha caratterizzato, hanno permesso di evidenziare le motivazioni sottese al ricorso sempre più ampio allo strumento del collegamento audiovisivo e le eventuali implicazioni sulle garanzie del giusto processo, quali oralità, immediatezza, contraddittorio e diritto di difesa. La tesi si sofferma, in particolare, sulle conseguenze della modalità da remoto sulle tradizionali modalità di assunzione della prova dichiarativa, approfondendo il valore del consenso delle parti e il caso del dichiarante vulnerabile. In ultimo, dopo aver passato in rassegna alcune ipotesi patologiche dell’istituto in esame, attraverso cenni di diritto comparato, si ipotizzano gli orientamenti futuri del legislatore.
