This thesis explores the issue of sustainable development in the textile and fashion sector through an interdisciplinary approach that combines comparative law and sociology of law. After outlining the methodological foundations of the research, the study examines the environmental crisis as a global phenomenon with significant social, legal, and economic implications. Special focus is placed on the textile industry, one of the most environmentally impactful sectors, and on recent regulatory interventions at both international and European levels, including the EU Strategy for Sustainable and Circular Textiles (2022). The research also addresses the role of commercial communication and advertising self-regulation, with a focus on the Italian system and a comparison with other European frameworks, highlighting how environmental claims can influence consumer behavior toward more responsible choices. An empirical investigation based on a questionnaire is also presented, aimed at assessing consumers’ perceptions of sustainability, their environmental and social awareness, and the cultural influence of fashion in shaping new identity models such as genderless fashion. The goal is to provide a critical analysis of the effectiveness and impact of sustainability policies in the textile sector from legal, social, and cultural perspectives.
La presente tesi analizza il tema dello sviluppo sostenibile nel settore tessile e della moda, adottando un approccio interdisciplinare che integra gli strumenti del diritto comparato e della sociologia del diritto. Dopo aver esaminato le basi metodologiche della ricerca, si approfondisce la crisi ambientale come fenomeno globale con rilevanti ricadute sociali, giuridiche ed economiche. Particolare attenzione è rivolta al comparto tessile, uno dei settori industriali più impattanti a livello ambientale, oggetto di recenti interventi normativi a livello internazionale ed europeo, tra cui la Strategia dell’UE per i prodotti tessili sostenibili e circolari del 2022. La tesi esplora anche il ruolo della comunicazione commerciale e dell’autodisciplina pubblicitaria, con un focus sul sistema italiano e un confronto con altri modelli europei, evidenziando come le asserzioni ambientali possano orientare i comportamenti dei consumatori verso scelte più responsabili. Infine, viene presentata un’indagine empirica, basata su un questionario, volta a indagare la percezione della sostenibilità da parte dei consumatori, il loro livello di consapevolezza ambientale e sociale, e il ruolo culturale della moda nella diffusione di nuovi modelli identitari, come la genderless fashion. L’obiettivo è offrire una lettura critica dell’efficacia e dell’effettività delle politiche di sostenibilità nel comparto tessile, valutandone l’impatto normativo, sociale e culturale.
