IL RUOLO DELLE AZIONI POSITIVE DI GENERE NELL’ORDINAMENTO COSTITUZIONALE: LA SFIDA DELLE PARI OPPORTUNITÀ

The paper aims to analyze the use of affirmative actions as a tool preordained to achieve the goal of equal opportunity between men and women. The examination begins with a reflection on the use of affirmative actions in their native context (the United States) as a tool to counter the phenomenon of racial segregation, and it continues on the evolution of affirmative actions as a means of overcoming gender discrimination. The analysis focuses on the Italian regulatory system and the contribution of case law, especially constitutional case law, highlighting critical aspects and possible lines of future development.

L'elaborato si propone di analizzare l'utilizzo delle azioni positive come strumento preordinato al raggiungimento dell'obiettivo delle pari opportunità fra uomini e donne. La disamina inizia da una riflessione sull'utilizzo delle azioni positive nel loro contesto natio (Stati Uniti) come strumento di contrasto al fenomeno della segregazione razziale, per proseguire sull'evoluzione delle azioni positive come mezzo di superamento delle discriminazioni di genere. L'analisi si focalizza su sistema normativo italiano e sull'apporto della giurisprudenza, soprattutto costituzionale, evidenziando gli aspetti critici e le possibili linee di sviluppo future.
