The paper aims to investigate the role of the Italian collective bargaining in the definition of rights and innovative protections for the disabled workers or the workers carers of not self-sufficient relatives. The research is based on a combined analysis of actions desk (analysis of the literature and the contractual texts) and field (a field research with twenty-seven interviews to members of the EESC and protagonists of the of national collective bargaining), and aims to outline the forecasts and safeguards contained in the twelve main Italian collective bargaining agreements and to identify good practices in second-level bargaining. The context is the implementation of the UN Convention in Italy and in Europe and the commitment that the Economic and Social Committee calls on the Member States, within the European Disability Strategy 2010-2020, to include specific clauses in collective bargaining to protect workers with disabilities or that provide care for a severely disabled or not self-sufficient person.
L’elaborato si propone di indagare il ruolo della contrattazione collettiva italiana nella definizione di diritti e innovazioni di tutela rivolte a lavoratori disabili o carer di parenti non-autosufficienti. La ricerca si fonda sull’analisi combinata di azioni desk (analisi della letteratura e dei testi contrattuali) e field (con una ricerca sul campo attraverso ventisette interviste a Consiglieri CESE e protagonisti della contrattazione nazionale), e mira a delineare l’insieme delle previsioni e tutele contenute nei dodici principali CCNL italiani in vigore e a identificare alcune buone pratiche di contrattazione di secondo livello. Il contesto è il recepimento della Convenzione ONU in Italia e in Europa, e l'impegno che il Comitato Economico e Sociale chiede agli Stati Membri, all'interno della Strategia Europea per le Disabilità 2010-2020, di inserire nella contrattazione clausole specifiche a tutela dei lavoratori con disabilità o che prestano assistenza a un disabile grave o non-autosufficiente.
