Il Consiglio Superiore della Magistratura. Dal modello alla sua evoluzione, in vista della sua riforma.

Il lavoro di tesi si propone di analizzare il ruolo che il Consiglio Superiore della Magistratura ha assunto e svolge nell’ordinamento italiano negli oltre sessant’anni dalla sua istituzione. In particolare, uno dei principali obiettivi della ricerca è quello di verificare se il cambiamento che il CSM ha subito nel corso del tempo attraverso l’ampliamento delle proprie funzioni abbia costituito un processo di trasformazione collocabile all’interno della cornice immaginata per l’organo dai Padri Costituenti oppure, al contrario, abbia rappresentato un superamento dei confini della Carta costituzionale; se l’evoluzione consiliare possa definirsi cioè come una realizzazione, per fasi successive, del modello costituzionale, o una vera e propria deviazione rispetto a quest’ultimo, tale da affermarsi l’esigenza di riportare l’organo laddove era stato pensato dalla Costituzione. All’interno della tesi vengono prese in considerazione le riforme del sistema elettorale per la selezione dei membri togati del Consiglio che si sono succedute negli anni e le varie proposte di modifica ad esse e alla disciplina della composizione dell’organo. L’obiettivo è di mettere in luce quali siano state le concezioni e gli obiettivi sottesi alle suddette riforme e proposte, con particolare riferimento alla natura e al ruolo che esse hanno inteso riconoscere all’istituzione. The thesis aims to analyze the role that the Superior Council of the Judiciary has taken on and plays in the Italian legal system in the more than sixty years since its establishment. In particular, one of the main objectives of the research is to verify if the change the SCJ has undergone in the course of the time through the widening of its own functions has constituted a transformation process that can be placed within the imagined frame for the organ by the Constituent Fathers or, on the contrary, it has represented an overstepping of the boundaries of the Constitutional Charter; whether the evolution of the Council can be defined as a realization, in successive stages, of the constitutional model, or a real deviation from the latter, such as to be affirmed the need to bring the body back to the pattern conceived by the Constitution. The thesis takes into account the reforms of the electoral system for the selection of the members elected by the magistrates of the Superior Council that have taken place over the years and the various proposals for changes to them and the discipline of the composition of the body. The aim is to highlight the concepts and objectives underlying these reforms and proposals, with particular reference to the nature and role they have intended to give to the institution.
