The thesis in question, being part of the disciplinary sector of Criminal Procedure Law, focuses on the analysis of the profiles relating to the precautionary and precautionary protection of victims of gender-based violence. In this perspective, the investigation conducted within the thesis moves from the historical origin of violence against women for gender reasons, examining the condition of women in the Greek world, in the Roman world and in the Middle Ages. The analysis of the phenomenon of gender-based violence, understood in its objective and subjective complexity, also takes into account the link between episodes of violence and the use of language; In this sense, the author takes into consideration the multiple forms of secondary victimization, from newspapers to courtrooms. The central theme is therefore found in the evaluation of the perspective of precautionary and precautionary protection, in the light of the regulatory changes introduced by the Red Code, the Cartabi Reform by Law no. 122/2023 and most recently by the Roccella Reform, Law no. 168/2023. With regard to precautionary protection, the study of the legislation contained in the Code of Criminal Procedure, the in-depth study of the argumentative theses developed by the doctrine, has made it possible to highlight the so-called plurifunctionality of precautionary measures; in particular, among the various functions to which they tend, particular importance is given to the need for speed in the conduct of judicial proceedings. Within the category of precautionary measures, in addition to arrest in flagrante delicto and detention, the measure of emergency removal from the family home, referred to in art. 384 bis of the Code of Criminal Procedure, which plays a central role in the field of gender-based and domestic violence. In addition, the thesis examines the regulatory evolution in the field of precautionary protection, starting from Law no. 154/2001, with which the measure of removal from the family home was introduced, referred to in art. 282 bis of the Code of Criminal Procedure. With regard to the same, it should be noted that the legislator also intended to introduce in the criminal field a measure that in some respects has profiles in common with the corresponding civil measure, the so-called protection order. In tracing the evolution of the precautionary system, attention was focused on Law no. 38/2009 which led to the introduction of the prohibition of approaching the places frequented by the injured person, provided for by art. 282-ter of the Code of Criminal Procedure, as well as the communication obligations enshrined in art. 282-quarter c.p.p. From the study of the regulatory evolution, it was possible to appreciate the innovations introduced with the so-called Red Code, in order to align our legal system with the supranational pressures. In particular, the innovations introduced with regard to the use of the electronic bracelet, its effectiveness and the powers of the judge are highlighted. In this perspective, the so-called "S.S. Guidelines of the Tivoli Public Prosecutor's Office, whose indications are particularly useful in order to facilitate the operation of the measures provided for by art. 282 bis and 282 ter of the Code of Criminal Procedure. The in-depth analysis of the various phases of precautionary protection also examined the New Red Code, introduced with Law no. 168/2023, with which the legislator intended to strengthen the system of protections in favor of the offended person, strengthening the regulatory arsenal aimed at combating the phenomenon of gender-based violence. Looking beyond the boundaries of our legal system, the doctoral thesis focuses on precautionary measures in the field of gender-based violence in the European perspective. In this regard, the models are compared the protection models of Spain, France and Germany.
La tesi in esame, inserendosi nel settore disciplinare del Diritto processuale penale, si sofferma sull’ analisi dei profili relativi alla tutela cautelare e precautelare delle vittime di violenza di genere. In quest’ottica, l’indagine condotta all’interno della tesi muove dall’origine storica della violenza contro le donne per motivi di genere, prendendo in esame la condizione della donna nel mondo greco, nel mondo romano e nell’epoca medievale. L’analisi del fenomeno della violenza di genere, inteso nella sua complessità oggettiva e soggettiva, tiene conto altresì del nesso intercorrente tra gli episodi di violenza e l’utilizzo del linguaggio; in tal senso, l’autore prende in considerazione le molteplici forme di vittimizzazione secondaria, dalle testate giornalistiche alle aule di giustizia. Il tema centrale dunque si rinviene nella valutazione della prospettiva di tutela precautelare e cautelare, alla luce delle modifiche normative introdotte dal Codice Rosso, dalla Riforma Cartabia, dalla L. n. 122/2023 e da ultimo la Riforma Roccella, L. n. 168/2023. Con riguardo alla tutela precautelare, lo studio della normativa contenuta nel codice di procedura penale, l’approfondimento delle tesi argomentative elaborate dalla dottrina, ha consentito di porre in evidenza la c.d. plurifunzionalità delle misure precautelari; in particolare, tra le diverse funzioni cui le stesse tendono, un particolare rilievo viene riconosciuto all’esigenza di celerità nello svolgimento dell’azione giudiziaria. All’interno della categoria delle misure precautelari si è analizzata, oltre all’arresto in flagranza e al fermo, anche la misura dell’allontanamento d’urgenza dalla casa familiare, di cui all’art. 384 bis c.p.p., che ricopre un ruolo centrale nell’ambito della violenza di genere e domestica. Inoltre, la tesi prende in esame l’evoluzione normativa in materia di tutela cautelare, a partire dalla L. n. 154/2001, con cui è stata introdotta la misura dell’allontanamento dalla casa familiare, di cui all’art. 282 bis c.p.p. Con riguardo alla stessa, occorre evidenziare come il legislatore abbia inteso introdurre altresì in ambito penale una misura che per certi aspetti presenta dei profili in comune con la corrispondente misura civilistica, il c.d. ordine di protezione. Nel tracciare l’evoluzione del sistema cautelare, si è concentrata l’attenzione sulla L. n. 38/2009 che ha condotto all’introduzione del divieto di avvicinamento ai luoghi frequentati dalla persona offesa, previsto dall’art. 282-ter c.p.p., nonché, degli obblighi di comunicazione sanciti dall’art. 282-quater c.p.p. Dallo studio dell’evoluzione normativa è stato possibile apprezzare le novità introdotte con il c.d. Codice Rosso, allo scopo di allineare il nostro ordinamento alle spinte sovranazionali. In particolare, si pongono in evidenza le novità introdotte con riguardo all’utilizzo del braccialetto elettronico, alla sua efficacia e ai poteri del giudice. In quest’ottica, meritano particolare attenzione le c.d. Linee Guida della Procura di Tivoli, le cui indicazioni risultano particolarmente utili al fine di favorire l’operatività delle misure previste dagli artt. 282 bis e 282 ter c.p.p. L’approfondimento delle varie fasi della tutela cautelare ha altresì preso in esame il Nuovo Codice Rosso, introdotto con la L. n. 168/2023, con cui il legislatore ha inteso rafforzare il sistema delle tutele a favore della persona offesa, potenziando l’arsenale normativo volto a contrasto del fenomeno della violenza di genere. Volgendo lo sguardo oltre i confini del nostro ordinamento, la tesi di dottorato si sofferma sulle misure cautelari in materia di violenza di genere nella prospettiva europea. A tal proposito vengono messi a confronto i modelli di tutela della Spagna, Francia e Germania.
