The research carried out essentially concerns the relationship between beach concessions and the selective principle, both in light of the Italian legislation which has been stratified over the last few years, and in light of European Union law, which has intervened in a particularly incisive way on the topic. The regulation of state maritime concessions for tourist-recreational use is therefore analyzed on a regulatory, doctrinal and jurisprudential level (both national and supranational), with a particular focus on the issue of the assignment of beach property. Having identified the multiple, conflicting interests, as well as the different branches of law (constitutional, urban planning, European Union, civil and criminal) that alternate on the topic in question, the research starts from the disorganisation and fragmentation present in domestic legislation, sources of the constant procrastination behavior of the national legislator. Therefore, having analyzed the rulings of the Court of Justice of the European Union, as well as of the Constitutional Court and the Council of State, called on several occasions to make up for the shortcomings of the internal legislator, we analyze the differences and similarities that the subject matter of the study presents with respect to the regulation of another large sector of our system which is characterized by public evidence, fully characterized by the selective principle: the regime of Public Contracts. The transparency, competition and publicity of the procedures for awarding beach concessions, much desired and prescribed by the European Union, can in fact only be found in a discipline, already of Community origin, covered by the same principles. The conclusions outline some proposals for reform of the sector that can remove the residual doubts harbored by local authorities regarding the applicability of the public contract legislation and guarantee its full application and, to this end, a standard tender is prepared in light of the indications provided by ANAC for the awarding of public contracts.
La ricerca svolta concerne essenzialmente il rapporto fra le concessioni balneari e il principio selettivo, tanto alla luce della normativa italiana che si è stratificata nel corso degli ultimi anni, quanto alla luce del diritto dell’Unione europea, intervenuta in modo particolarmente incisivo sul tema. La disciplina delle concessioni demaniali marittime ad uso turistico-ricreativo viene dunque analizzata sul piano normativo, dottrinale e giurisprudenziale (sia nazionale che sovranazionale), con uno sguardo volto, in particolare, al tema dell’affidamento del bene spiaggia. Rilevati i plurimi interessi, tra loro confliggenti, nonché le diverse branche del diritto (costituzionale, urbanistico, Unione europea, civile e penale) che si avvicendano sul tema in questione, la ricerca prende avvio dalla disorganicità e dalla frammentarietà presenti nella normativa domestica, fonti della costante condotta di procrastinazione del legislatore nazionale. Analizzate, dunque, le pronunce della Corte di Giustizia dell’Unione europea, nonché della Corte costituzionale e del Consiglio di Stato, chiamate a più riprese a sopperire alle mancanze del legislatore interno, si analizzano le diversità e le analogie che la materia oggetto dello studio presenta rispetto alla disciplina di un altro grande settore del nostro ordinamento che risulta caratterizzato dall'evidenza pubblica, connotato a pieno titolo dal principio selettivo: il regime dei Contratti Pubblici. La trasparenza, la concorrenza e la pubblicità delle procedure di affidamento delle concessioni balneari, tanto agognate e prescritte dall’Unione europea, possono rinvenirsi, infatti, soltanto in una disciplina, già di derivazione comunitaria, lambita dai medesimi principi. Nelle conclusioni si delineano alcune proposte di riforma del settore che possano rimuovere i residui dubbi nutriti dagli enti locali circa l’applicabilità della normativa dei contratti pubblici e garantirne la piena applicazione e, a tal fine, si predispone un bando-tipo alla luce delle indicazioni fornite dall’ANAC per l’affidamento degli appalti pubblici.
