This work analyses the evolution of anticipatory and summary relief in Italian civil procedure, tracing its historical development up to the current framework established by the Cartabia Reform. Specifically, the research focuses on the new court orders granting and dismissing claims pursuant to Articles 183-ter and 183-quater c.p.c., examining their docket-reduction and expediting logic in connection with the stringent objectives of the PNRR. Using the référé provision and summary judgment models as comparative benchmarks, the study highlights the complex operational issues and systemic limitations of these anticipatory orders. From this perspective, this work aims to evaluate the actual practical effectiveness of these new instruments and their viability within the delicate balance between the demand for maximum procedural efficiency and the preservation of due process rights.
Il presente lavoro analizza l’evoluzione delle tutele anticipatorie e sommarie nel processo civile italiano, tracciandone lo sviluppo storico fino all’attuale assetto, delineato dalla Riforma Cartabia. Nello specifico, l’indagine si concentra sulle nuove ordinanze di accoglimento e rigetto della domanda ex artt. 183-ter e 183-quater c.p.c., analizzandone la ratio deflattiva ed acceleratoria connessa agli stringenti obiettivi del PNRR. Assumendo come parametro comparatistico i modelli del référé provision e del summary judgment, vengono evidenziate le complesse problematiche operative ed i limiti sistematici propri delle ordinanze anticipatorie. In questa prospettiva, l’elaborato ambisce a valutare la reale efficacia pratica di questi nuovi strumenti e la loro tenuta nel delicato bilanciamento tra le istanze di massima efficienza processuale e il rispetto delle garanzie del contraddittorio.
