The research explores the transformation of job classification regulation in labor law. In the first part, it examines the role that the “creative worker” does or may come to play within a new business model—one no longer organized according to rigid hierarchies but along horizontal lines—and the relationship between automation and the replacement of human labor, with a focus on employment dynamics and the strategies adopted by companies to meet the challenges of digital transformation. Adopting a diachronic approach, the analysis of the literal content of Article 2103 of the Civil Code, alongside a reflection on the interpretative and practical issues raised by the changes introduced by Article 3 of Legislative Decree no. 81/2015, makes it possible to trace precise lines of continuity and discontinuity between the law, case law, and legal scholarship. This serves to identify new dynamic balances between rights and economic freedoms in the ongoing redefinition of the map of powers and counterpowers (both individual and collective) in the everyday reality of the workplace. The analysis then focuses on the unprecedented centrality attributed to collective bargaining by the legislator, and the concrete effects that the new rules are producing in the individual employment relationship. Particular attention is paid to the hesitation and resistance expressed by the social partners in this regulatory effort. In this context, the research investigates the factors that contribute to either the rigidity or, where present, the reformist tendencies of classification schemes in the Italian system of industrial relations. Lastly, it observes how company-level bargaining is shaping the design of performance evaluation systems and the mechanisms linking professionalism and remuneration.
La ricerca esplora la trasformazione della disciplina delle mansioni nel diritto del lavoro. Nel primo segmento, si analizza il ruolo che il “lavoratore creativo” può o potrà ricoprire all’interno di un modello di impresa nuova, organizzata secondo un assetto non più rigidamente gerarchico ma orizzontale e sul rapporto tra automazione e sostituzione del lavoro, con un approfondimento sulle dinamiche occupazionali e sulle strategie adottate dalle imprese per affrontare le sfide della trasformazione digitale. Adottando un approccio diacronico, l’esame del dato letterale dell’art. 2103 c.c., accompagnato da una riflessione sui problemi interpretativi e applicativi conseguenti alle modifiche apportate alla materia dall’art. 3 del d.lgs. n. 81/2015, permette di individuare precise linee di continuità/discontinuità tra la giurisprudenza e la dottrina nella ricerca di nuovi punti dinamici di bilanciamento fra diritti e libertà economiche nel processo di ridefinizione della mappa dei poteri e dei contropoteri (individuali e collettivi) nella vita quotidiana dell’ambiente di lavoro. Per l’effetto, la riflessione, si focalizza sull’inedita centralità che il legislatore ha riconosciuto alla contrattazione collettiva, per spostarsi, ancora, sul piano delle conseguenze che le nuove disposizioni stanno producendo sul concreto atteggiarsi del rapporto di lavoro tra le parti individuali del contratto, dedicando ampio spazio alla registrazione delle ritrosie e delle resistenze manifestate dalle parti sociali nella loro regolazione. Nel merito, tale sezione è dedicata all’individuazione dei fattori che stanno determinato la rigidità, o diversamente il “riformismo” (ove e se vi è stato), degli schemi di classificazione del personale nel sistema di relazioni industriali italiano. Si osserva, infine, l’impatto che la contrattazione aziendale sta avendo sulla definizione dell’impianto e delle procedure valutative delle performance professionali e sui meccanismi di collegamento tra professionalità e retribuzione.
