The dissertation, entitled “Personal preventive measures and fair trial”, concerns procedural aspects of the personal preventive system as regulated by Legislative Decree 159/2011. The dissertation is structured in four chapters. The first chapter deals with the historical evolution of prevention trial. In particular, it underlines how, from the end of XIX century up to the present days, the prevention trial slowly passed from having administrative nature – that of police measures – to having indisputably recognized jurisdictional nature. The second and the third chapters are aimed at providing a reconstruction of the current legislation in force. In particular, the second chapter analyses the “static” aspects of the subject matter and focus the attention on the interference between prevention trial and criminal trial, while the third chapter illustrates the rules governing the prevention trial, in light of the case law. The fourth chapter is aimed at providing some insights for the structuring of a “fair personal prevention trial”. In a de jure condendo perspective, the author proposes to follow three different evolution lines. First, the author wishes a “re-discovery” of the principle of proportionality in the preventive sector, so as to allow the application of only those measures deemed appropriate to deal with the different forms of danger taken into account by the legislator. Secondly, the author indicates what progress could still be made in terms of defensive guarantees, in order to implement the principles of fair trial established by the Constitution and the European Convention on Human Rights. Finally, the author observes that in order to remedy the interference between the criminal trial and the prevention trial, a change in the type of offence would need to be made, by identifying behaviours which are symptomatic of danger and which are not associated with criminally relevant facts.
La tesi, intitolata “Misure di prevenzione personali e giusto processo”, ha ad oggetto i profili processuali del sistema di prevenzione personale disciplinato dal d.lgs. 159/2011. L’elaborato si articola in quattro capitoli. Il primo capitolo è dedicato all’evoluzione storica del procedimento di prevenzione. In particolare, viene messo in luce come, dalla fine del XIX secolo a oggi, si sia lentamente passati da un procedimento avente natura amministrativa – quello delle misure di polizia – a un processo cui è pacificamente riconosciuta natura giurisdizionale. Il secondo e il terzo capitolo sono dedicati alla ricostruzione della disciplina vigente. In particolare, nel secondo capitolo vengono analizzati i profili “statici” della materia e vengono messe in luce le interferenze tra il processo di prevenzione e il processo penale, mentre nel terzo capitolo viene illustrata la disciplina del procedimento, alla luce dell’elaborazione giurisprudenziale. Il quarto capitolo, infine, è dedicato ad alcuni spunti di riflessione per la costruzione di un “giusto processo di prevenzione personale”. In un’ottica de jure condendo, si propone di seguire tre diverse linee evolutive. Per prima cosa, viene auspicata una “riscoperta” del principio di proporzionalità in materia preventiva, in modo da consentire l’applicazione delle sole misure ritenute idonee a fronteggiare le diverse forme di pericolosità prese in considerazione dal legislatore. In secondo luogo, l’autore indica quali passi in avanti potrebbero essere ancora compiuti sul piano delle garanzie difensive, al fine di attuare i principi del giusto processo sanciti dalla Costituzione e dalla Convenzione europea dei diritti dell’uomo. Infine, l’autore osserva che per porre rimedio alle interferenze tra processo penale e processo di prevenzione occorrerebbe un mutamento delle fattispecie preventive, individuando delle condotte sintomatiche di pericolosità che non si identificano con fatti penalmente rilevanti.
